Sons file lawsuit for death of mother in IL car-train crash

A wrongful death lawsuit claims that crossing gates and warning lights were not working properly at a railroad crossing where a mother of three from Granite City was hit and killed by an Amtrak train on February 28, 2012. The lawsuit, filed in Madison County, Illinois on behalf of the the woman’s three sons, claims that the crash was not her fault and that she was not “trying to beat the train” through the crossing.

It is alleged in the lawsuit that a maintenance crew had been working on safety equipment at the railroad crossing within the 30 minuted before the deadly crash.

“Our review of the site indicates that it would be impossible for her to cross the tracks with the barriers down at this particular intersection,” said an attorney for the plaintiffs. “The gates and lights simply failed to activate, warn and protect [her] from the train.”

The defendants named in the suit include National Railroad Passenger Corporations d/b/a Amtrak, Union Pacific Railroad Co., Kansas City Southern Railway Co. and Western-Cullen Hayes Inc., a company that makes railroad crossing warning and safety devices.

The accident occurred at the crossing on Bissell Street at Illinois Route 3. The woman’s sons all are under 11 years-old.
